SANTE HAITI — Terms of Service

1. Acceptance of terms
By creating an account, submitting a care request, or using SANTE HAITI, you agree to these Terms and to our Privacy Policy.
2. What SANTE HAITI is (and isn’t)
SANTE HAITI is a platform for coordinating home healthcare services — nursing visits, home health aides, and companion care — for patients located in Haiti. SANTE HAITI is not a hospital, not an emergency service, and does not replace the judgment of a licensed physician. Nurses and caregivers on the platform are responsible for practicing within their license and scope of practice under Haitian law.
3. Who may use the platform, and submitting on behalf of a patient
You may use SANTE HAITI as: the patient themselves; a family member or other authorized representative arranging care for a patient; or a nurse, caregiver, or administrator providing services through the platform. If you submit a care request or medical information on behalf of someone else, you represent that: (a) you have that person’s permission to share their information with SANTE HAITI, or you otherwise have lawful authority to act for them; (b) you will inform them that SANTE HAITI holds their information; and (c) the information you provide is accurate to the best of your knowledge. Misrepresenting your authority to act for a patient is a violation of these Terms and may result in account termination.
4. Payments
Fees for services are shown before you confirm a request. Payments may be processed via MonCash (Digicel), NatCash (Natcom), or card, depending on what is available to you. Refund and cancellation terms for a given service are shown at the time of booking. You authorize us and our payment processors to charge the payment method you provide for services you request.
5. Accounts
You are responsible for keeping your login credentials confidential and for activity on your account. Tell us immediately at support@santehaiti.com if you believe your account has been accessed without authorization.
6. Nurse and caregiver conduct
Nurses and caregivers agree to provide care consistent with their training, license, and Haitian healthcare regulations, to document visits accurately, and to treat patient information as confidential, accessible only for the purpose of providing care.
7. Prohibited use
You may not use the platform to submit false medical information, to submit another person’s information without the authority described in Section 3, to harass staff or caregivers, or to attempt to access records you are not authorized to see.
8. Disclaimers and limitation of liability
SANTE HAITI facilitates connections between patients, families, and care providers; we are not the provider of medical care itself. To the maximum extent permitted by law, SANTE HAITI is not liable for the acts or omissions of independent nurses/caregivers, for outcomes of care, or for indirect or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Termination
We may suspend or terminate an account that violates these Terms, including misuse of patient consent obligations under Section 3.
10. Governing law
These Terms are governed by the laws of the jurisdiction in which Sante Haiti LLC is organized, without regard to conflict-of-law principles, except where Haitian law mandatorily applies to the provision of healthcare services within Haiti.
11. Changes
We will post the effective date and version number above when these Terms change. Continued use after a material change constitutes acceptance.
